Paragliding Guide S.L.

1. Nature of the Activity

Paragliding is an inherently hazardous aerial sport that involves significant risks, including but not limited to serious injury, permanent disability, or death. These risks may arise from, among other things, weather conditions, terrain, equipment failure, pilot error, the actions of other pilots, and unforeseen environmental factors.

By participating in any activity, trip, coaching programme, holiday, or service offered by Paragliding Guide S.L., you expressly acknowledge and accept the inherent risks associated with paragliding and related activities.


2. Pilot Qualification and Responsibility

All clients of Paragliding Guide S.L. are qualified and rated paragliding pilots who hold a valid certification appropriate for the flights undertaken.

You acknowledge and agree that:

  • You are solely responsible for your own decisions as a pilot in command

  • You retain full authority and responsibility for:

    • Whether or not you fly

    • Where you choose to launch and land

    • How you conduct your flight

    • Your assessment of weather, conditions, and risks

  • You understand that Paragliding Guide S.L. does not provide tandem flights, instruction for unqualified pilots, or pilot-in-command services

Paragliding Guide S.L. acts exclusively as a coaching, guiding, and logistical support provider, not as an operator assuming control over your flight decisions.


3. Coaching, Briefings, and Site Information

Any briefings, coaching input, weather discussions, site introductions, or advice provided by Paragliding Guide S.L.:

  • Are offered for informational and coaching purposes only

  • Do not constitute instructions, commands, or operational control

  • Do not remove or reduce your responsibility as pilot in command

The final decision to fly or not fly always remains entirely yours.


4. Equipment Responsibility

You acknowledge and agree that:

  • You are solely responsible for the selection, maintenance, inspection, and airworthiness of your own paragliding equipment

  • Paragliding Guide S.L. does not supply flight equipment unless explicitly stated in writing

  • Paragliding Guide S.L. accepts no responsibility or liability for:

    • Equipment failure

    • Incorrect setup or packing

    • Wear, tear, or damage to your equipment

    • Loss or theft of equipment


5. Travel, Transport, and Accommodation

Paragliding Guide S.L. may provide:

  • Ground transport to and from flying sites

  • Shared accommodation as part of a trip or holiday package

You acknowledge that:

  • Transport is provided as a logistical service only

  • Accommodation is provided on a shared-use basis

  • You remain responsible for your own personal safety, belongings, and conduct

  • Participation in any non-flying activities is entirely at your own risk

Nothing in the provision of transport or accommodation implies acceptance of responsibility for paragliding activities or outcomes.


6. Mandatory Insurance Requirement

Valid and appropriate insurance is a strict condition of participation.

You confirm that you hold current travel insurance that explicitly includes:

  • Paragliding (as a declared activity, not excluded)

  • Emergency medical treatment

  • Hospitalisation

  • Search and rescue

  • Medical evacuation and repatriation

General travel insurance that excludes aerial sports or adventure aviation is not sufficient.

Paragliding Guide S.L. reserves the right to:

  • Request proof of insurance

  • Refuse participation if adequate insurance is not held

  • Terminate services without refund if insurance requirements are not met


7. Limitation of Liability

To the maximum extent permitted under Spanish and European Union law, you agree that:

  • You participate entirely at your own risk

  • Paragliding Guide S.L., its directors, employees, contractors, and affiliates shall not be held liable for:

    • Personal injury or death

    • Loss, damage, or theft of property or equipment

    • Delays, cancellations, or changes due to weather or safety decisions

    • Actions or decisions taken by you as pilot in command

Nothing in this acknowledgement excludes or limits liability that cannot legally be excluded under applicable law, including liability for gross negligence or wilful misconduct where such exclusion is prohibited.


8. Acceptance and Understanding

By booking, participating in, or continuing to use the services of Paragliding Guide S.L., you confirm that:

  • You have read and understood this Acknowledgement of Risk

  • You understand the nature and risks of paragliding

  • You accept full responsibility for your actions and decisions

  • You voluntarily assume all risks associated with participation


9. Governing Law and Jurisdiction

This Acknowledgement of Risk shall be governed by and interpreted in accordance with the laws of Spain. Any disputes shall be subject to the jurisdiction of the competent courts of Spain, without prejudice to applicable consumer protection rights under EU law.
